Question: Our company is preparing to construct a building for low-income earners in Hanoi. What is the procedure in relation with the sale, rent or lease purchase of the apartments that we need to comply?
Answer:
The procedure for sale, rent or lease purchase of houses for low-income earners have been regulated by the Ministry of Construction in the Circular No. 36/2009/TT-BXD dated November 16, 2009.
After commencement of the project, the investor shall be responsible for providing the information related to the project: name of the project, investor, contact address, address for filing application, project location, project implementation schedule, project scale, number of apartments including: number of apartments for sale, for rent, for lease purchase, starting time and ending time for receiving the application and other related information to publicize at the head office and on the website of the Department of Construction where the project is located and posting at least one issue on a newspaper of the local authority and announcing at the real estate trading floor of the investor (if any) for the people to know, apply and supervise.
The investor shall have to report to the Department of Construction for their acknowledgement and inspection in writing on the total apartments for sale, rent, lease purchase and the starting time for sale, rent, and lease purchase.
After receiving the application dossiers of the people in need, the investor shall be responsible for verifying each dossier, comparing with regulations on subjects, conditions and priorities to make a list of the people eligible for buying, renting, lease purchasing the apartments.
The investor shall have to provide the Department of Construction with the list of people entitled to buy, rent or lease purchase in the priority order. The Department of Construction shall check and inform the investor of the eligibility of the people in that list. After 15 working days from the date of receiving the list, if the Department of Construction does not respond then the investor shall inform the people in the list to finalize and enter into the contracts.
After entering into the contracts, the investor shall be responsible for making a list of people who has purchased, rent, lease purchased, sending to the Department of Construction and archiving for managing and inspecting tasks. Currently, the investor shall have to publicize this list the its head office and real estate trading floor or website of house for low-income earners (if any).
